Terms of Service

The short version. Breakstep is free to play. You do not need an account. It is paid for by advertising, and rewarded videos are always optional. Your progress lives on your device, so uninstalling the game deletes it. Play fairly, do not try to break or modify the game, and do not redistribute it.

1. Accepting these terms

These Terms of Service (“Terms”) are an agreement between you and devbynight (“we”, “us”, “our”) covering the Breakstep mobile game and this website (the “Service”). By downloading, installing or playing Breakstep you accept these Terms. If you do not accept them, do not use the Service.

Breakstep is intended for players aged 13 and over. If you are under the age of majority where you live, you should read these Terms with a parent or guardian.

2. Your licence to play

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play Breakstep on devices you own or control, for your own private, non-commercial entertainment.

This is a licence to play the game, not a sale of it. We keep all rights we do not expressly grant you here.

Interfering with advertising in these ways is the one item here with a direct consequence for us: ad networks treat it as invalid traffic and it can remove the funding that keeps the game free.

4. Advertising

Breakstep is free and supported by advertising supplied by Google AdMob. By playing you accept that the game displays ads, as described in our Privacy Policy.

Rewarded video ads are always optional. They play only when you tap an offer, and the reward is granted only if the video is watched to the end. If a rewarded video fails to load, is interrupted, or is closed early, no reward is given — and no part of the game is locked behind one. Every level in Breakstep can be reached and completed by playing.

We choose the ad formats and their placement, but we do not create the ads themselves and do not control what individual advertisers say. We request only ad content rated suitable for a general audience. If you see an ad you believe is inappropriate, please tell us at devbynight1@gmail.com with a screenshot if you can, and we will report it to the network.

5. Spools and unlockables

The game contains an in-game currency (“spools”) and unlockable moves. These exist only inside the game. They have no monetary value, are not your property, cannot be exchanged for money or anything outside the game, and may not be sold or transferred.

We may adjust the balance of the game — including the cost of unlocks and how spools are earned — as part of updating and improving it.

6. Your progress

Breakstep has no account system and no cloud save. All of your progress is stored locally on your device.

Uninstalling the app, clearing its data, resetting or losing your device will permanently delete your progress. It cannot be recovered by you or by us, because we never receive a copy of it. Please treat this as a known and deliberate limitation rather than a fault.

7. Availability & changes

We aim to keep Breakstep working and available, but we do not guarantee that it will be uninterrupted or error-free. We may update, change, suspend or discontinue the game or any of its features at any time. We may also stop distributing the game entirely; if we do, previously installed copies will normally keep working, but we cannot guarantee they will continue to function on future operating system versions.

8. Intellectual property

Breakstep, including its name, code, artwork, animation, music, sound, characters, story and this website, is owned by devbynight and protected by copyright and other laws.

You may freely record, stream and publish video of your own gameplay, including monetised video, as long as you do not present the game as your own work and do not distribute the game's assets or a modified version of the game itself.

9. Third-party services & stores

Breakstep is distributed through app stores operated by third parties and uses services provided by Google. Your use of those stores and services is also governed by their own terms. Where an app store's terms give you rights that conflict with these Terms, that store's terms take precedence for that store's part of the relationship.

These Terms are between you and devbynight only. Apple and Google are not parties to them and are not responsible for the game or for providing support for it.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be excluded under the law of your country.

11. Limitation of liability

To the fullest extent permitted by law, devbynight will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of data — including lost game progress — arising out of or connected with your use of the Service.

Because Breakstep is provided free of charge, our total liability to you for any claim relating to the Service is limited to the amount you have paid us for it, which is normally zero. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

12. Termination

You may end this agreement at any time by uninstalling the game. We may suspend or end your licence if you materially breach these Terms, in particular section 3. Sections 5, 8, 10, 11 and 13 survive termination.

13. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, and the courts of India will have jurisdiction over any dispute. If you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer protections of your country of residence, and may bring proceedings there where your law gives you that right.

14. Changes to these terms

We may update these Terms. The date at the top of this page shows when they last changed. Continuing to play after a change means you accept the updated Terms; if you do not accept them, uninstall the game.
