Terms of Service

1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your access to and use of the StixCam mobile application and this website (the “Service”), provided by StixCam (“StixCam”, “we”, “us”). By downloading, accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are a minor in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service you represent that you meet these requirements.

3. Licence to use StixCam

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the Service for your own non-commercial purposes. You may not copy, modify, reverse-engineer, decompile, resell, rent, or create derivative works of the Service, except to the extent this restriction is prohibited by law.

4. Your content & responsibilities

You are solely responsible for everything you capture, create, store and share using the Service, including photos, cut-outs and stickers (“Your Content”).

• You represent that you have all necessary rights, permissions and consents to photograph, capture and use the subjects in Your Content, and that Your Content and your use of it do not violate any law or the rights of any person (including privacy, publicity, intellectual-property and data-protection rights).
• You will not capture or make stickers of other people without their consent where such consent is required, or of any content that is unlawful, infringing, defamatory, obscene, hateful, harassing, or that depicts minors inappropriately.
• You retain ownership of Your Content. Because cut-outs are created and stored on your device, we do not claim ownership of Your Content. To the limited extent needed to operate features you use (for example, storing your stickers locally or enabling sharing), you grant us the permissions necessary to provide those features.
• You are responsible for backing up Your Content. Uninstalling the app or losing your device may permanently delete it.

5. Acceptable use

You agree not to: (a) use the Service for any unlawful, harmful or abusive purpose; (b) infringe anyone’s intellectual-property, privacy or publicity rights; (c) upload or distribute malware or attempt to disrupt, overload or gain unauthorised access to the Service or its systems; (d) circumvent usage limits, security, attestation or billing; (e) use the Service to harass, threaten or harm others; or (f) misrepresent your identity or affiliation. We may suspend or terminate access for any violation.

6. Subscriptions, free tier & billing

• Free tier. The Service offers a limited number of free stickers per month (currently three). Free limits may change over time.
• StixCam Pro. Optional subscriptions (monthly or yearly) and a one-time lifetime purchase unlock additional features. Prices are shown in the app and localised by the app store for your region.
• Free trials. Where offered, a free trial converts to a paid subscription automatically at the end of the trial unless you cancel beforehand.
• Billing & auto-renewal. Purchases are processed by Google Play or the Apple App Store, not by us. Subscriptions renew automatically for the same period at the then-current price unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Managing & cancelling. You manage and cancel subscriptions through your Google Play or Apple account settings. Uninstalling the app does not cancel a subscription.
• Refunds. Payments are generally non-refundable except where required by the applicable app store’s policies or by law. Refund requests are handled by the app store.
• Price changes. We may change prices and plan features. Changes to an active subscription’s price will be handled in accordance with the app store’s rules and applicable law.

7. Intellectual property

The Service, including its software, design, logo, name, graphics and content we provide (but excluding Your Content), is owned by StixCam or its licensors and is protected by intellectual-property laws. Except for the licence granted above, no rights are transferred to you. “StixCam” and our logo are our marks and may not be used without permission.

8. Third-party services & app stores

The Service relies on third-party services (for example Google Firebase and app-store billing). Your use of those services is subject to their terms, and we are not responsible for them. Your download and use of the app are also subject to the terms of the app store you obtained it from (Google Play or Apple). Those stores are not parties to these Terms and are not responsible for the Service.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT CUT-OUTS OR OTHER RESULTS WILL BE ACCURATE OR MEET YOUR EXPECTATIONS, OR THAT CONTENT WILL NOT BE LOST. YOU USE THE SERVICE AT YOUR OWN RISK. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL STIXCAM OR ITS OWNERS, EMPLOYEES OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR CONTENT, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) INR 5,000 (OR EQUIVALENT). Some jurisdictions do not allow the limitation of certain damages, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify, defend and hold harmless StixCam and its owners, employees and agents from and against any claims, damages, liabilities, losses and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content; (b) your use or misuse of the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

12. Termination

You may stop using the Service and uninstall the app at any time. We may suspend or terminate your access to the Service at any time, with or without notice, including for violations of these Terms or to protect the Service or others. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability and indemnification) will survive.

13. Governing law & dispute resolution

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to applicable law, the courts of India will have exclusive jurisdiction over any dispute, and you consent to that jurisdiction and venue. Before filing any claim, you agree to first contact us at hello@stixcam.app and attempt in good faith to resolve the matter informally. Nothing in these Terms limits any mandatory consumer rights you may have under the laws of your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. General

These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
